Introduction

Using this site you can send an order for filing applications for EU Trade Mark (EUTM) and Community Design (RCD) registration as well as for conducting a trademark search in the territory of the European Union (EU). Applicants, who are non-EU member states residents, can register their marks and designs in the European Union Intellectual Property Office (EUIPO) through professional representatives from EUIPO list. Our agency provides a full range of services in respect of registration and protection of EUTM and RCD.

EUTM and RCD after registration thereof are valid in the territory of the European Union, i.e. in 28 countries, namely: Austria, Belgium, Bulgaria, Croatia, Cyprus, the Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, and the United Kingdom.

Trademark information

Please enter trademark name in the corresponding column. Any type of letters can be used (either Latin or Cyrillic, capital or small letters, etc.).

 

List of goods/services

Furthermore, it is necessary to indicate the class of goods/services in respect of which the trademark search shall be conducted. All goods and services are split according to the International Classification of Goods and Services (Nice Classification, 9th edition). If you know the class which the necessary goods/services relate to, tick the numbers of the corresponding classes and click “Add”.

If you do not know the class, write the corresponding goods and services in the field for searching the term. Corresponding results appear upon typing the first three letters. The search of goods/services is conducted amongst the terms of the Nice Classification. Please tick the number of the class and press “Add”. When necessary, please repeat the search in respect of the goods and services. The more classes you tick, the higher the search costs, as each additional class involves additional fee.

If the indicated goods/services are not found amongst the terms of the Nice Classification, you may try to define the class using EUIPO database – EuroClass. Then please tick the number of the class and click “Add”.

If it is difficult for you to choose the number of the class, please click “Request” in order to send us a message concerning the goods and services. You will need to enter your name, e-mail address and the goods/services you are interested in, as well as optionally other contact details and comments so that we could contact you and provide the necessary consultation.

In the field of the corresponding class you can specify the goods and services of the class of your special interest. This will be helpful for more comprehensive analysis of the search results by our patent attorneys.

Forwarding documents

If you require original documents (signed and sealed invoice or agreement on payment of the invoice), please tick the corresponding columns and indicate the type of the mail, via which you would prefer to receive the documents (registered letter, courier mail). If you require an agreement for payment of the invoice, the standard agreement form will be forwarded to the e-mail indicated by you. Filing EU Trade Mark application

 

EUTM application is filed with the European Union Intellectual Property Office (EUIPO) in Alicante, Spain. For filing we require information on the trademark, goods and services, in respect of which it is going to be registered, information on the applicant, as well as contact information.

Trademark information

Please indicate the type of your trademark in the corresponding column – word or device trademark.

If the column “word” is chosen, it is necessary to enter trademark name. You can use any type of letters (either Latin or Cyrillic letters, capital or small letters, etc.). If the column “device” is chosen, it is necessary to upload the trademark image. The uploaded file can be of any size and format. However, it shall be noted that the trademark application shall contain the representations in .jpg format. If the uploaded file is of other format, the distortion of colors is possible when converting the same into .jpg format. At that the bigger format size, the longer uploading.

 

List of goods/services

Furthermore, it is necessary to indicate the list of goods/services, in respect of which the trademark shall be registered. All goods and services are split according to the International Classification of Goods and Services (Nice Classification, 9th edition). If you know the class, which the necessary goods/services relate to, tick the numbers of the corresponding classes. After ticking the number of the class, the field with the list of goods/services, which according to the International Classification are included into the said class, will appear. It is necessary to select the goods/services by ticking the corresponding columns. Besides, you can mark the column with the class heading. Further on, please click “Add”.

If you do not know the class number, type the corresponding goods and services in the field for goods/services search. Corresponding results appear upon typing the first three letters. Please mark the corresponding goods/services. After this a list of all goods/services included into the said class according to the International Classification, from which you can select additional goods/services, will appear. Then, please click “Add”. If necessary, please, repeat the search in respect of other goods/services pressing the button “Add” at the end. 

The selected goods/services will be displayed in the field with the number of class. The more classes you choose, the higher the price of the order, as each additional class in excess of three is subject to an extra fee. 

If the indicated goods/services are not found amongst the terms of the International Classification, you may try to define the class using OHIM database - EuroClass. Then please tick the number of the class, select any term from the list and click “Add”. The term selected by you will appear in the field of the corresponding class, which can be corrected for the term found in EuroClass. 

If it is difficult for you to choose the number of the class, please click the field “Request” in order to send us a message concerning the goods and services. You will need to enter your name, e-mail address and the goods/services you are interested in, as well as optionally other contact details and comments, so that we could contact you and provide the necessary consultation.

In the field of the corresponding class you can correct the list of goods/services by adding parenthetic words, punctuation, etc. The application will be filed in respect of goods and services, which are indicated in the order form.

Applicant

Further, it is necessary to indicate the applicant of the trademark. Please indicate in the corresponding field the name of the company (if the applicant is legal person) or the full name of the applicant (if the applicant is natural person), address, as well as phone, fax, e-mail and URL (if any).

 

Conventional priority

If the identical application was firstly filed in any country within the last six months, you have a possibility to claim the conventional priority. This gives the applicant a right to set the priority of EUTM not according to the date of filing thereof with EUIPO, but according to the date of filing of the first application. The convention priority is taken into account and gives advantage when conflict situations concerning identical or similar trademarks applied for registration within the period between filing of the first application and the EUTM application appear. For claiming conventional priority when filing EUTM it is necessary to indicate the number of the first application, filing date and the country, wherein the first application was filed.

Seniority

If the applicant or the owner of EUTM already has national or international registration of the same trademark valid in one or several countries of the European Union in respect of identical goods/services, he can claim seniority for EUTM, preserving earlier rights to this mark in these countries, at that these national or international registrations can be lapsed. Seniority is taken into account on considering the issue of earlier rights conflict in this country.

Please tick the appropriate box if you wish to claim the seniority for your trademark. Seniority may refer to different countries. The costs for this service amount 80 EUR for each country. Select the country – member of the EU where the registration exists and type registration number and date.


National search

A national search is conducted by national patent offices of 7 countries (Czech Republic, Denmark, Greece, Lithuania, Hungary, Romania and Slovakia) after filing the Community application on request of the Office for Harmonization in the Internal Market. The search is of informative character, ordered on filing the application and costs 183 EUR including 84 EUR official fee and conducted within 2 months by the national patent offices. OHIM search reports are forwarded to the applicant as well as to the owners of the found earlier trademarks. Therefore, the owners of the earlier rights are notified on the presence of the later identical or similar trademark and can probably proceed with preparing and filing an opposition. This service is subject to a certain fee by the Office for Harmonization in the Internal Market. 

 

Forwarding documents

EUIPO does not forward any paper certificates of EUTM registration. The certificate is published in the OHIM database. If you require such certificate (in a stamped envelope) for reporting, please tick the appropriate box and we will print it out on good-quality paper using high-quality printer and forward to you via courier mail. The costs of this service will amount 70 EUR excluding postal expenses.

Filing RCD application

 

RCD application is filed with the European Union Intellectual Property Office (EUIPO) in Alicante, Spain. For RCD filing we require the image thereof, indication of product, applicant’s data as well as contact information.

To order services in respect of preparing and filing the application, please click “Registered Community Design registration - Online filing” and fill in order form.

 

Number of Community designs

One application can include unlimited number of designs, if they relate to one of 32 classes of the Locarno Classification and are filed in the name of one applicant. There is no requirement for the unity of designer’s concept and no obligatory condition that the articles included into the application shall be the embodiments of one article. For each design in excess of one the reducing fee is provided. Please select the number of designs in the corresponding column of the order form. 

 

Locarno Classification

The application shall mention the title of the design. EUIPO strictly recommends using the terms of the International Classification for Industrial Designs (Locarno Classification). First, you are required to tick the class, to which the design relates. If the application contains one design, you can tick as many classes as you want. If the application contains more than one design, it can relate only to one class of the Locarno Classification. The only exception is class 32.00 “ornamentation”: you can file unlimited number of designs in two classes, one of which is class 32.00 “ornamentation” by ticking the corresponding field.

Design

For each design you are required to mention the subclass, to which it relates, to choose the term from the list of products and click “Add”. In the field “Indication of product” the chosen terms will appear.

 

Image of the design

For each design it is necessary to upload the image thereof. The uploaded file can be of any size and format. However, it shall be noted that the RCD application shall contain the images in .jpg format.  If the uploaded file is of other format, the distortion of colors is possible when converting the same into .jpg format. At that the bigger the format size, the longer downloading. The minimum number of images for one design – 1, the maximum – 7.

 

Designer

You are required to indicate the full name of the designer in the application. If the design is created by a group of designers, you are required to mention the full names of the members of the group.

 

Conventional priority

If the identical application was firstly filed in any country within the last six months, you have a possibility to claim the conventional priority. This gives the applicant a right to set the priority of RCD not according to the date of filing thereof with OHIM, but according to the date of filing of the first application. The conventional priority is taken into account and gives advantage when conflict situations concerning identical or similar design applied for registration within the period between filing of the first application and the application for registration of RCD appear. For claiming conventional priority when filing RCD it is necessary to mention the number of the first application, filing date and the country, wherein the first application was filed. Later the copy of the first application certified by the Patent Office of the country of the first application shall be filed with OHIM. Within two months you are required to send us the certified copy of the application vie e-mail (scanned colour copy) to info@triarobit.com or to the address of Agency TRIA ROBIT of Vilandes street 5-2, Riga, LV-1010, Latvia.

Applicant

Further, it is necessary to indicate the applicant of the design. Please indicate in the corresponding field the name of the company (if the applicant is legal person) or the full name of the applicant (if the applicant is natural person), address as well as phone, fax, e-mail and URL (if any).

 

Deferment of publication

RCD can be published not right after registration but within 30 months after registration thereof. For this on filing the application you are required to claim the deferment of publication. If you would like to defer the publication of the design, please tick the appropriate box and indicate the date, when publication is required.

OHIM does not forward any paper certificates of RCD registration. The certificate is published in the EUIPO database. Payment information

Please choose the type of payment: wire transfer, credit card (VISA/MASTER CARD/AMERICAN EXPRESS) or PayPal; enter the information, if necessary, then click “Continue”. Wire transfer is done on the basis of the issued invoice, which will be forwarded to you via e-mail within two working days. You will have 30 days for payment of the invoice. We will start executing your order, when the money appears on our account. If within 45 days the mentioned amount is not assigned to our account, the order will be cancelled.

 

Order confirmation

Please check the completed data, read the User Agreement, tick that you agree with the conditions thereof and click “Order Confirmation”. On the screen you will see our confirmation on the order acceptance for execution, which will be later also sent to your e-mail. If you are registered user, you can see all your orders in the “My account”. You can add new service or amend the order by moving to the cart and following the link “Edit Your Cart”.

 

Review of your order

The registered users can review their orders in “My account”.

 

Processing and executing your order

Within two working days we will forward you our invoice. The application filing and the search (except the search of all trademarks valid in the EU) are conducted within two working days since the payment is assigned to our account. The search of trademarks valid in the EU is conducted within ten working days. If you have paid by credit card or using PayPal system, the execution of your order starts immediately. The copy of the filed application or search report with our opinion will be forwarded to the mentioned e-mail address. All the correspondence from the OHIM and the registration certificate will be sent to you via e-mail.
